An Ogun State businessman, Ashiru Azeez, has petitioned the state Attorney General and Commissioner for Justice, Oluwasina Ogungbade, seeking a review of the Directorate of Public Prosecutions, DPP, legal advice in a case involving alleged assault, theft and other offences.
Azeez, through his lawyer, Ayodeji Ifonlaja, alleged that the DPP dropped several serious charges initially recommended by the police against suspects accused of attacking and robbing him and other victims.
According to the lawyer, the police initially recommended about nine counts against the defendants, including assault occasioning harm, malicious damage and stealing. He alleged that several of the charges were later omitted, leaving mainly assault related allegations.
Azeez said about eight members of the alleged gang were arrested following efforts by his family, but only one suspect was eventually arraigned.
He also alleged that the case file became difficult to locate within the state Ministry of Justice and that some of the suspects were allegedly boasting that the case had been abandoned.
The businessman is asking the Attorney General to review the DPP’s February 24, 2026 legal advice and determine whether the charges reflect the findings contained in the police case file.
However, the Attorney General said the decision was based on the facts of the case, describing the matter as fundamentally a land dispute involving an alleged disruption of a meeting.
Ogungbade maintained that the circumstances did not support an armed robbery charge and said the suspects would be prosecuted for assault. He also explained that prosecutors have discretion to determine appropriate charges based on the facts and the interest of justice.
