The Federal High Court in Abuja has struck out the eight-count criminal charge filed by the Federal Government against Adeniyi Adeyemi, the alleged fake Director-General of the Presidential Foreign Intervention Promotion Council, PFIPC.
Justice Mohammed Garba Umar struck out the charge on Monday following an application by the Federal Government to discontinue the case and transfer it to the High Court of the Federal Capital Territory for fresh arraignment.
The Director of Public Prosecutions of the Federation, Rotimi Oyedepo, a Senior Advocate of Nigeria, told the court that the Attorney-General of the Federation had reviewed the case file and identified issues with the original charges.
According to the prosecution, the alleged offences involving forged documents fell within the jurisdiction of the FCT High Court rather than the Federal High Court.
Oyedepo informed the court that fresh charges had already been filed before the FCT High Court and that Adeyemi would be arraigned again without delay.
Counsel to Adeyemi, Ibrahim Angulu, did not oppose the application, allowing the judge to strike out the existing charge.
Adeyemi, 38, had been facing allegations bordering on conspiracy and forgery alongside two other defendants whose whereabouts remain unknown.
The case arose from allegations that Adeyemi operated a purported government agency and used forged documents in connection with its activities.
The decision to strike out the charge does not amount to an acquittal, as the Federal Government intends to pursue the case through a fresh prosecution at the FCT High Court.
