Former Vice President Atiku Abubakar and the African Democratic Congress, ADC, have asked the Federal High Court in Abuja for permission to amend their suit challenging President Bola Tinubu’s eligibility to contest the 2027 presidential election.
The suit, marked FHC/ABJ/CS/1888/2026, also has the All Progressives Congress, APC, and the Independent National Electoral Commission, INEC, as defendants.
At Monday’s proceedings, counsel to Atiku and the ADC, Joseph Silas, informed Justice Inyang Ekwo that the plaintiffs had filed an application seeking to amend their originating summons.
The court confirmed that the parties had been served with the relevant processes and had responded to the application.
Justice Ekwo subsequently adjourned the case until October 13, 2026, for hearing of the motion to amend the originating summons.
Atiku and the ADC instituted the suit in August, questioning Tinubu’s eligibility to contest the 2027 presidential election. Their case includes allegations concerning the National Youth Service Corps, NYSC, discharge certificate submitted to INEC.
The plaintiffs said the proposed amendments would correct errors in their original filing, provide clearer copies of some exhibits and provide additional details supporting their claims.
Tinubu, APC and INEC have opposed the proposed amendments and challenged the competence of the substantive suit. Tinubu and the APC have denied submitting any forged certificate to INEC.
The court is expected to determine whether the plaintiffs will be allowed to make the proposed amendments when the matter comes up on October 13.
